Retailer Requirements
|
(a) A person who is a retailer of computer equipment may not sell or offer to sell new computer equipment in this state unless the equipment is labeled with the manufacturer's label and the manufacturer is included on the commission's list of manufacturers that have recovery plans. (b) Retailers can go to the commission's Internet site as and view all manufacturers that are listed as having registered a compliant collection program. Covered electronic products from manufacturers on that list may be sold in or into the State of Texas. (c) A retailer is not required to collect computer equipment for recycling or reuse.

Each manufacturer is responsible only for its own brand(s) of computer equipment. The collection and recycling must be convenient and free at the time of recycling. Manufacturers may choose to offer recycling for brands other than their own.

Any manufacturer that chooses to opt-out of the State Standard Program for a program year would need to submit a draft plan to the Agency no later than June 1 of the previous year, in order to allow time for the Agency to review the plan for completeness, post it for public comment, and to allow enough time for the manufacturer to implement their program by January 1.

For television manufacturers only. The manufacturer obligation for computers extends only to the brands which have been discontinued for as long as the manufacturer wishes to sell in or into Texas.

Enforcement Authority for Sale of Unregistered Products

The commission may conduct audits and inspections to determine compliance. The commission and the attorney general shall take enforcement action against any manufacturer, retailer, or person who fails to comply. A retailer who receives a warning notice from the commission that the retailer's inventory is in violation because it includes computer equipment from a manufacturer that has not submitted the recovery plan must bring the inventory into compliance with this subchapter not later than the 60th day after the date the warning notice is issued.
